| dc.description.abstract | Este trabalho tem como objetivo analisar a possibilidade da responsabilidade civil por danos morais causados ao marido que registrou filho advindo de relacionamento extraconjugal em virtude da indução em erro provocada por sua esposa e as consequências jurídicas e psicológicas que essa conduta danosa pode causar à vida da vítima. O método utilizado foi o dedutivo, uma vez que se partiu da análise doutrinária e jurisprudencial acerca do tema abordado no presente para alcançar o resultado almejado. Ao final do estudo constatou-se que a reparação dos danos morais quando causados por violação dos deveres conjugais não pode ilidir a responsabilidade do cônjuge causador, especialmente, em decorrência de o marido registrar civilmente um filho que não era seu. Nesse contexto, a responsabilidade civil da mulher é subjetiva, uma vez que o dever de indenizar dependerá da comprovação de culpa. Assim, a mulher que, no convívio conjugal, violar o dever de fidelidade e, consequentemente, induzir o marido a registrar filho advindo de relacionamento alheio poderá responder a ação indenizatória por danos morais, a fim de inibir e reprimir as condutas danosas decorrentes desse ato e, ainda, o pai tem a faculdade de ajuizar ação de anulação de ato jurídico. | pt_BR |
| dc.description.abstract | This project aims to analyze the possibility of civil liability for the damages caused to a husband who has registered as his own, misled by his wife, a child from her extramarital relationship and the psychological and legal consequences that such misconduct may cause in the victim's life . The deductive method was used since it was necessary to start with an analysis of the available doctrine and jurisprudence regarding the subject of the present research to finally achieve the desired result. At the end of the study it was found that the compensation for the personal injury caused by the violation of marital duties cannot rebut the responsibility of the spouse who has given cause to the mistake, especially when a husband registers a child as his own when that was not the case. In this context, the liability of the misleading wife is subjective, since the duty of compensation depends on proof of her guilt. Therefore, the woman that, in a marital interaction, violates the duty of loyalty and thereby induces her husband to register her extramarital child can be sued to respond to personal injury proceedings, aiming to inhibit and suppress the harmful behaviors resulting from this act. Furthermore, the father has the right to act towards the annulment of the register. | en |
