Resumo
Este trabalho tem como foco o estudo da ampliação da licença paternidade. Essa licença é um benefício concedido pelo empregador ao
empregado, a contar do momento do nascimento de seu filho, pelo período de cinco dias consecutivos, sem alteração de seu salário. Assim, esta pesquisa tem por objetivo principal entender por qual razão o período concedido de licença paternidade é inferior ao período concedido à mulher na licença maternidade, tendo em vista que ambos são iguais perante a Constituição Federal, assim como as significativas mudanças no conceito de família contemporânea. Para tanto, a pesquisa se utilizará de uma análise do conceito de igualdade de gênero perante a
Constituição Federal, após será realizado uma breve análise do conceito de família e posteriormente um estudo detalhado do benefício da licença maternidade e da licença paternidade perante aos filhos, com enfoque principal no estudo da Consolidação das Leis do Trabalho e na Constituição Federal, assim como o uso de doutrina, análise de julgado e projetos de leis sobre o assunto. Conclui-se então que, com a igualdade de gênero e os avanços no conceito de família, assim como novos entendimentos perante a legislação brasileira sobre a licença paternidade, os cuidados do pai com os filhos acaba se tornando cada vez mais frequente e eficaz na vida familiar.
Abstract: This paper focuses on the study of extending paternity leave. This leave is a benefit granted by the employer to the employee, from the moment their child is born, for a period of five consecutive days, with no change to their salary. The main objective of this research is therefore to understand why the period of paternity leave granted is shorter than the period granted to women on maternity leave, bearing in mind that both are equal under the Federal constitution, as well as the significant changes in the concept of the contemporary family. To this end, the research will use an analysis of the concept of gender equality under the Federal constitution, then a brief analysis of the concept of family and then a detailed study of the benefits of maternity leave and paternity leave for children, focusing mainly on the study of the Consolidation of Labor Laws and the Federal Constitution, as well as the use of doctrine, analysis of judgments and draft laws on the subject. We can therefore conclude that, with gender equality and advances in the concept of the family, as well as new understandings of paternity leave in Brazilian legislation, the father's care for his children is becoming increasingly frequent and effective in family life.
