Resumo
Tendo em vista a crescente relevância das famílias multiespécies, o presente estudotrata sobre a possibilidade de guarda compartilhada e pagamento de pensão alimentícia para “pets”, a fim de assegurar o bem-estar dos animais de estimação e a harmonia familiar. Para tanto, foi necessário analisar os institutos legais da guarda e dos alimentos no ordenamento jurídico brasileiro, adaptar esses conceitos para incluir os animais de estimação e explorar casos práticos que ilustram essas novas dinâmicas familiares. Realizou-se, então, uma pesquisa bibliográfica, comparando diferentes fontes e sintetizando conhecimentos sobre o tema. Diante disso, verificou-se que a guarda compartilhada de “pets” permite a continuidade dos laços afetivos e a distribuição de responsabilidades entre os tutores, enquanto a pensão alimentícia assegura que as necessidades dos animais sejam atendidas adequadamente. Pela
jurisprudência, é possível perceber que a guarda compartilhada de “pets” está avançada, porém ainda há um caminho a ser percorrido para reconhecer plenamente a possibilidade de pensão alimentícia para animais. Foi possível concluir que a adaptação das leis para reconhecer os direitos dos animais nas famílias multiespécies é essencial para promover uma convivência harmoniosa e respeitosa, refletindo as mudanças sociais contemporâneas. Este estudo pretende servir como base para pesquisas futuras sobre a integração legal dos animais nas estruturas familiares.
Given the growing relevance of multispecies families, this study addresses the possibility of shared custody and payment of alimony for pets, in order to ensure the well-being of pets and family harmony. To this end, it was necessary to analyze the legal institutions of custody and food in the Brazilian legal system, adapt these concepts to include pets and explore practical cases that illustrate these new family dynamics. A bibliographical research was then carried out, comparing different sources and synthesizing knowledge on the topic. In view of this, it was found that shared custody of pets allows the continuity of emotional ties and the distribution of responsibilities between guardians, while alimony ensures that the animals' needs are dequately met. Based on the case law, it is possible to see that shared custody of pets is advanced, but there is still a way to go to fully recognize the possibility of alimony for animals. It was possible to conclude that adapting laws to recognize the rights of animals in multispecies families is essential to promote harmonious and respectful coexistence, reflecting contemporary social changes. This study intends to serve as a basis for future research on the legal integration of animals into family structures.
