| dc.description.abstract | The general objective of this work was to present the importance and importance of the Investigation and Prevention System (SIPAER) for the investigation and prevention of air accidents in Brazil. An exploratory research was carried out with bibliographic and documentary procedures, thus selecting articles, books, reports and regulations that could contribute to the development of the theme. After the development of the study, it is concluded that the investigations of aeronautical accidents carried out by the aeronautical authorities do not have any objective of blaming or making the individual responsible, whether in the civil, administrative or penal scope. However, this does not mean that investigations for the investigation of crimes and culprits are prohibited, police investigations can always occur if there is suspicion of illicit conduct as a contributing factor to injuries or damages to others, including to enforce the State's duty to enforce the appropriate sanctions when fraud is proven. However, as stated, the aeronautical authorities have the sole intention of investigating to prevent new occurrences. One of the reasons for this is to ensure that as much information as possible can be collected, as well as voluntary testimonials by professionals in the field. | dc.description.abstract | O objetivo geral deste trabalho foi apresentar a importância a importância do Sistema de Investigação e Prevenção (SIPAER) para a investigação e prevenção de acidentes aéreos no Brasil. Foi feita uma pesquisa exploratória com procedimento bibliográfico e documental, assim foram selecionados artigos, livros, reportagens e regulamentos que pudessem contribuir para com o desenvolvimento do tema. Após o desenvolvimento do estudo, conclui-se que as investigações de acidentes aeronáuticos realizadas pelas autoridades aeronáuticas não têm qualquer objetivo de culpabilizar ou responsabilizar o indivíduo, seja no âmbito civil, administrativo ou penal. No entanto, isto não significa que inquéritos para a apuração de crimes e culpados sejam proibidos, as investigações policiais podem ocorrer sempre houver suspeitas de condutas ilícitas como fator contribuinte para lesões ou danos ao outrem, inclusive para fazer cumprir o dever do Estado em aplicar as devidas sanções quando o dolo for comprovado. Porém, como dito, as autoridades aeronáuticas têm por único intuito investigar para prevenir novas ocorrências. Uma das razões para isso é fazer com que o máximo de informações possam ser coletadas, bem como depoimentos voluntários sejam dados por profissionais da área. O que se espera com as investigações conduzidas pelo SIPAER é fortalecer para que haja uma cultura fortemente comprometida com a segurança operacional do voo. | pt_BR |
