Resumo
O presente trabalho tem como objetivo geral abordar os principais argumentos favoráveis a inconstitucionalidade da substituição tributária progressiva do ICMS. Para a elaboração deste estudo, pode-se classificar a pesquisa, quanto ao nível, como exploratória; quanto à abordagem, como qualitativa; e quanto ao procedimento para coleta de dados, como bibliográfica e documental. Os resultados indicam que a substituição tributária viola vários princípios constitucionais. Viola ao princípio da estrita legalidade no viés da tipicidade e da segurança jurídica, pois o fato presumido não se alinha perfeitamente com a previsão normativa e a base de cálculo não reflete o conteúdo econômico do fato gerador. A exigência de conteúdo econômico mensurável reflete também na ofensa ao princípio da capacidade contributiva no seu aspecto absoluto. Há aviltamento da competência tributária, porquanto a Constituição exige uma lei complementar para regular o assunto, mas a Lei Kandir delegou essa responsabilidade às leis estaduais. Além disso, a exigência antecipada de tributo esbarra na proibição ao confisco e distorce a imposição da não cumulatividade. Por fim, conclui-se que instituto não pode ser empregado de maneira indiscriminada pelo fisco, uma vez que devem ser observados os princípios constitucionais e não apenas a simples facilitação da atividade fiscalizatória do Estado.
The general objective of this work is to address the main arguments in favor of the unconstitutionality of the progressive tax substitution of the ICMS. The level of this work can be categorized as exploratory. The approach used was qualitative. The meanings of collecting data was bibliography and documental research. The results indicate that tax substitution violates several constitutional principles. It violates the principle of strict legality in terms of typicality and legal certainty, as the presumed fact does not perfectly align with the normative prediction and the calculation basis does not reflect the economic content of the triggering event. The requirement for measurable economic content reflects an offense against the principle of contributory capacity in its absolute aspect. There is a degradation of tax jurisdiction, as the Constitution requires a complementary law to regulate the matter, but the Lei Kandir delegated this responsibility to state laws. Furthermore, the advance tax requirement conflicts with the prohibition of confiscation and distorts the imposition of non-cumulative status. Finally, it is concluded that the institute cannot be used indiscriminately by the tax authorities, since constitutional principles must be observed and not just the simple facilitation of the State's inspection activity.
