A guarda compartilhada como instrumento de mitigação da alienação parental: reflexões acerca dos interesses do menor.

Resumo
O presente artigo trata-se dos efeitos decorrentes da dissolução conjugal e a síndrome da
alienação parental quando se verifica o instituto da guarda compartilhada, de modo que, pode
ser vista como um mecanismo válido para evitar aquela e, por conseguinte, preservar os
interesses da criança envolvida. A par disso, toma-se como base o sistema e as estruturas
familiares atuais, visto que, as dissoluções conjugais são recorrentes, especialmente pela
inexistência de obrigação de perpetuidade matrimonial. Por outro lado, as dissoluções
acarretam inúmeros problemas, dentre eles, a guarda do filho do casal, razão pela qual, muitas
vezes, o genitor que possui a guarda unilateral, realiza determinadas manobras a fim de
afastar o outro genitor da convivência com o filho, o que, por muitas vezes, torna um
obstáculo na manutenção de um vínculo afetivo e familiar saudável. Nesse diapasão, referidas
manobras utilizadas pelo genitor para afastar o outro são denominados como síndrome da
alienação parental. Assim sendo, conclui-se que o instituto da guarda compartilhada, tem-se
como objetivo prevenir, de forma eficaz, a síndrome da alienação parental.
This article deals with the effects resulting from marital dissolution and the parental alienation syndrome when the institution of shared custody occurs, so that it can be seen as a valid mechanism to avoid that and, therefore, preserve the interests of the child involved. In addition, the current family system and structures are taken as a basis, since marital dissolutions are recurrent, especially due to the lack of obligation of marital perpetuity. On the other hand, dissolutions cause numerous problems, including custody of the couple's child, which is why, often, the parent who has unilateral custody carries out certain maneuvers in order to remove the other parent from living with the child. , which often becomes an obstacle to maintaining a healthy emotional and family bond. In this sense, these maneuvers used by the parent to keep the other away are called parental alienation syndrome. Therefore, it is concluded that the institute of shared custody aims to effectively prevent parental alienation syndrome and, consequently, enabling a harmonious coexistence between the child and their parents, so that, results in joint responsibility for the rights and duties of the couple's child, thus preserving the best interests of the child.
