dc.description.abstract	The current crisis in Venezuela demonstrates a series of factors that contribute to the migratory crisis in the countries close to it. With a significant increase in the entry of Venezuelan migrants into Brazilian territory through the Brazil-Venezuela border, geographically through the state of Roraima, the government of the state of Roraima instituted Decree No. 25.681/2018 giving the state security forces special powers. An original civil action was also filed at the Federal Supreme Court requiring the control/closure of the border with Venezuela. Thus, this monograph aims to analyze the treatment given to Venezuelan migrants in Brazil in relation to the legal aspect and, to achieve this purpose, verify whether the request for closure of the border by the state of Roraima and the limitation of access of venezuelans to Brazil is supported by the Constitution of the Federative Republic of Brazil, international treaties adopted by Brazil and the Law on Migration (Law No. 13.445/2017). To achieve this objective, a case study was carried out, as well as a documentary research, with qualitative approach and exploratory level, according to the data collection, analyzing bibliographies on the theme, verification of the news and the decree established by the state of Roraima. For data collection, the study was based on doctrines, legislation, news and scientific articles. From the results obtained, it was concluded that Decree Nº 25.681/2018 and the requests submitted to the Federal Supreme Court by the state of Roraima violate the Brazilian legislation and international treaties adopted by Brazil and listed in this work, because they did not respect the basic principles of human rights protection when they differentiate migrants from nationals, giving treatment to Venezuelan migrants in disagreement with the legal system. However, currently after the precautionary suspension of the state decree and the judgment of the merit of the Action still pending, the state of Roraima is looking for measures to adapt the migrants in the Brazilian territory.	en
dc.description.abstract	A atual crise na Venezuela demonstra uma série de fatores que colaboram para a crise migratória que vivem os países próximos a este. Com um aumento significante na entrada dos migrantes venezuelanos no território brasileiro pela fronteira Brasil-Venezuela, geograficamente através do estado de Roraima, o governo do estado de Roraima instituiu o Decreto nº 25.681/2018 dando às forças estaduais de segurança do estado poderes especiais. Foi ainda protocolada Ação Cível Originária no Supremo Tribunal Federal requerendo o controle/fechamento da fronteira com a Venezuela. Deste modo, esta monografia tem como objetivo analisar o tratamento conferido aos migrantes venezuelanos no Brasil quanto ao aspecto jurídico e, para alcançar tal finalidade, verificar se o pedido de fechamento da fronteira pelo estado de Roraima e a limitação de acesso de venezuelanos ao Brasil tem respaldo na Constituição da República Federativa do Brasil, tratados internacionais adotados pelo Brasil e na Lei de Migração (Lei nº 13.445/2017). Para alcançar tal objetivo, realizou-se um estudo de caso, bem como uma pesquisa documental, com abordagem qualitativa e nível exploratório, de acordo com a coleta de dados, analisando bibliografias sobre o tema, verificação das notícias e o decreto instituído pelo estado de Roraima. Para a coleta de dados, o estudo se baseou em doutrinas, legislações, notícias e artigos científicos. A partir dos resultados obtidos, concluiu-se que o Decreto nº 25.681/2018 e os pedidos apresentados ao Supremo Tribunal Federal pelo estado de Roraima ferem a legislação brasileira e os tratados internacionais adotados pelo Brasil e elencados neste trabalho, pois não respeitaram os princípios básicos de proteção aos direitos humanos quando diferenciam os migrantes dos nacionais, conferindo aos migrantes venezuelanos tratamento em desconformidade com o ordenamento jurídico. Entretanto, atualmente após a suspensão cautelar do decreto estadual e o julgamento do mérito da Ação ainda pendente, o estado de Roraima está procurando medidas para adequação dos migrantes no território brasileiro.	pt_BR
