dc.description.abstractThe theme of this work is "International humanitarian law and its application in situations of armed conflict", being justified through the knowledge that despite the great technological and intellectual advance of individuals there is still international conflicts and that there are several people who work in search of world peace. It has risen as problematic: what are the delimitations imposed by the norms of international humanitarian law in cases of armed conflict? It aimed to establish and distinguish the greatest challenges to international humanitarian law in armed conflicts. And as specific objectives: to conceptualize international humanitarian law on armed conflicts, analyze the standards in force in the Geneva Protocols for armed conflicts, document disrespect for Geneva protocols and identify the application of international humanitarian law today. The study is characterized as a bibliographic and documentary research. It was found that war has always been present along with human evolution, in the past it was not a worrying factor as in current times, because from population growth, the advancement of technologies and trade relations between countries, legitimation about the use of force became a cause for concern. With the realization of it it it was possible to show that the various armed conflicts, in the past and present, demonstrate the effectiveness of action in the face of the search for international humanitarian law, and world peace has always been desired. However, it is believed that there is still much to be done, especially with regard to legislation and their applicability.en
dc.description.abstractDireito Internacional Humanitário e sua aplicação em situações de “conflito armado”, sendo justificado mediante o conhecimento de que, apesar do grande avanço tecnológico e intelectual dos indivíduos ainda ocorrem conflitos internacionais e que são várias as pessoas que trabalham em busca da paz mundial. Levantou-se como problemática: quais são as delimitações impostas pelas normas do Direito Internacional Humanitário em casos de conflitos armados? Teve como objetivo geral estabelecer e distinguir os maiores desafios ao Direito Internacional Humanitário em conflitos armados. E como objetivos específicos: conceituar o Direito Internacional Humanitário sobre conflitos armados, analisar as normas vigentes nos Protocolos de Genebra para os conflitos armados, documentar o desrespeito aos protocolos de Genebra e identificar a aplicação do Direito Internacional Humanitário na atualidade. O estudo é caracterizado como uma pesquisa bibliográfica e documental. Constatou-se que a guerra sempre esteve presente junto com a evolução humana, antigamente não era um fator preocupante como nos tempos atuais, pois a partir do crescimento populacional, do avanço das tecnologias e das relações comerciais entre os países, a legitimação acerca da utilização da força passou a ser um motivo de inquietação. Com a realização do mesmo, foi possível evidenciar que os vários conflitos armados no passado e no presente, demonstram a efetividade de atuação diante da busca pelo Direito Internacional Humanitário, sendo que a paz mundial sempre foi almejada. Todavia, acredita-se que ainda há muito que se fazer, especialmente, no que se refere às legislações e suas aplicabilidades.pt_BR
