Resumo
A presente monografia concerne à pesquisa sobre o princípio da máxima efetividade, resguardado no § 1° do artigo 5° da Constituição da República Federativa do Brasil, que prescreve a aplicação imediata às normas definidoras de direitos fundamentais. Destarte, a pesquisa objetiva o estudo dos direitos sociais como direitos fundamentais, de maneira que sepossa obter a realização plena destes. Para tanto, faz-se a análise dos conceitos e antecedentes históricos dos direitos fundamentais e, em especial, dos direitos sociais como direitos fundamentais. Mostram-se, ainda, as principais classificações doutrinárias necessárias para a compreensão do tema, verificando-se, por oportuno, a multifuncionalidade dos direitosfundamentais. Posteriormente, há a investigação sobre o princípio da máxima efetividade, com conceituação e explicação das funções dos princípios em sentido amplo. Após, passa-se a estudar as diferenças existentes entre eficácia jurídica e efetividade, segundo alguns doutrinadores. Verifica-se, no mesmo sentido, a presença de instrumentos processuais constitucionais que visam à superação das omissões pelo legislador derivado. Por derradeiro, aprecia-se o princípio da máxima efetividade decorrente das normas definidoras de direitos fundamentais, embasando a pesquisa, especificamente, nos direitos fundamentais sociais de cunho prestacional, que, normalmente, são considerados normas programáticas. Todavia, apesar desta caracterização, estes direitos podem se apontados como direitos jurídicosubjetivos, ou seja, são direitos que possuem sua justiciabilidade garantida. Devido à amplitude e à complexidade inerente ao tema abordado, utilizar-se-á o método indutivo, com pesquisa bibliográfica por meio de abordagem teórica e em legislações sobre o tema proposto, cujos dados serão analisados qualitativamente
This monograph refers to research on the principle of maxim effectiveness, protected in paragraph 1st of article 5th of the Constitution of the Federative Republic of Brazil, which prescribes the immediate application to the defining rules of fundamental rights. Thus, the research aims the social rights rules as fundamental rights, so that it can get the fullperformance of these. For that, it is made the analysis of concepts and historical antecedents of fundamental rights and, in particular, of social rights as fundamental rights. It is still shown the main doctrinal classifications that are necessary for the understanding of the subject, verifying, by appropriate, the multi-functionality of fundamental rights. Subsequently, there is an investigation on the principle of maxim effectiveness, with conceptualization and explanation of the functions of the principles in a wide sense. After, it is studied the existing differences between legal validity and effectiveness, according to some legal scholars. It is verified, in the same direction, the presence of constitutional procedural tools that aim to overcome the omissions by the derivative legislator. Finally, it esteems the principle ofmaxim effectiveness resulting from defining rules of fundamental rights, based on the research, specifically, the social fundamental rights prestacional character, which usually are considered programmatic rules. However, despite this characterization, these rights may be pointed as legal-subjective rights, that is, they have ensured its justice. Due to the magnitude and complexity inherent in the approached subjects, it will be used the inductive method, with bibliographical search through theoretical approach and legislation on the proposed subject, whose data will be qualitatively analyzed
