Alimentos gravídicos: verificação da responsabilidade civil pela falsa atribuição de paternidade, análise doutrinária e jurisprudencial

Resumo
OBJETIVO: verificar a responsabilidade civil da genitora em situações de falsa atribuição de
paternidade e examinar as perspectivas doutrinárias e jurisprudenciais relacionadas a esta
responsabilidade. METODOLOGIA: esta pesquisa é caracterizada como exploratória,
adotando uma abordagem qualitativa. Quanto ao procedimento, enquadra-se como coleta de
dados bibliográficos, fundamentada na doutrina, e documental, utilizando-se da legislação e das
decisões dos Tribunais de Justiça do Rio Grande do Sul, São Paulo e Ceará. RESULTADOS: o
instituto dos alimentos regula a obrigação alimentar, estabelecendo normas para sua fixação e
execução. Em princípio, os alimentos são irrepetíveis, personalíssimos, impenhoráveis,
irrenunciáveis e possuem outras características específicas. CONCLUSÃO: os alimentos
gravídicos garantem o direito ao desenvolvimento digno do nascituro, conforme estipulado pela
Lei nº 11.804/08, podendo ser requeridos contra aqueles em que existem indícios de paternidade
mediante ação de alimentos gravídicos. A possibilidade de enriquecimento ilícito pode se
configurar na relação alimentar, resultando em pagamento indevido, devido a uma causa ilícita.
A relativização do princípio da irrepetibilidade dos alimentos gravídicos pode ser caracterizada
por meio da ponderação de direitos, embasada nos dados apresentados nos autos. Considerando
a análise jurisprudencial, a devolução ou repetição do indébito alimentar é possível somente
quando comprovada a má-fé da genitora na imputação e ingresso da ação. Assim, na perspectiva
da autora, a via mais adequada para a compensação em pauta consiste na busca de indenização
frente à responsabilidade civil.
GOAL: Examine the civil liability of the mother in situations of false paternity attribution and analyze the doctrinal and jurisprudential perspectives related to this responsibility. METHODOLOGY: This research is characterized as exploratory, adopting a qualitative approach. Regarding the procedure, it falls under bibliographic data collection, grounded in doctrine, and documentary, using legislation and decisions from the Courts of Justice of Rio Grande do Sul, São Paulo, and Ceará. RESULTS: The institute of alimony regulates the alimentary obligation, establishing rules for its determination and execution. In principle, alimony is non-repayable, highly personal, non-seizable, non-waivable, and possesses other specific characteristics. CONCLUSION: Gravidic alimony ensures the right to the dignified development of the unborn, as stipulated by Law No. 11,804/08, and can be requested against those with indications of paternity through the action of gravidic alimony. The possibility of unjust enrichment can be configured in the alimentary relationship, resulting in undue payment due to an illicit cause. The relativization of the principle of non-repeatability of gravidic alimony can be characterized by weighing rights, based on the data presented in the case. Considering jurisprudential analysis, the reimbursement or repetition of undue alimony is possible only when the mother's bad faith in the attribution and filing of the action is proven. Thus, from the author's perspective, the most suitable approach for the compensation at hand is the pursuit of indemnification in the face of civil liability.
