O presente trabalho busca retratar as mais diversas experiências com um cadastro de pessoas condenadas por crimes sexuais. De natureza qualitativa e caráter metodológico teórico e documental, inicialmente, é apresentada a Lei de Megan (Megan’s Law), relatando os efeitos de sua aplicação nos mais de 20 anos que esta entrou em vigor nos Estados Unidos da América. Posteriormente, relata-se as tentativas de aplicação de um sistema similar no ordenamento jurídico brasileiro, até a promulgação da Lei n. 14.069, de 1º de outubro de 2020, que criou o Cadastro Nacional de Pessoas Condenadas por Crime de Estupro, a partir de uma análise dos preceitos constitucionais e dos direitos fundamentais dos agentes condenados.
The present work seeks to portray the most diverse experiences with a registry of people convicted of sexual crimes. Of qualitative nature and theoretical and documental methodological character, initially, Megan's Law is presented, reporting the effects of its application in the more than 20 years that it has been in force in the United States of America. Afterwards, it is reported the attempts of application of a similar system in the Brazilian legal system, until the promulgation of the Law n. 14.069, of October 1st, 2020, that created the Cadastro Nacional de Pessoas Condenadas por Crime de Estupro, from an analysis of the constitutional precepts and the fundamental rights of the convicted agents.
