Resumo
Muitas temáticas do âmbito digital possuem legislação ao redor no mundo, porém no Brasil esta realidade não se configura, apesar do surgimento de alguns esboços normativos nesse cenário. Dessa forma, o objetivo do presente trabalho incide em averiguar a sucessão hereditária dos chamados bens digitais, que ajuntam no seu bojo noções de natureza existencial e patrimonial. Nesse sentido, a herança digital é, então, a verificação de que o falecido deixa não somente coisas fungíveis, palpáveis, substanciais, mas também bens infungíveis, sendo isto a temática central desta pesquisa. A metodologia utilizada fora de cunho revisório bibliográfico, tendo como viés a pesquisa analítica da literatura jurídica, normas e jurisprudências. Como resultados, tem-se destacado a conceituação dos bens digitais, suas características e classificações, bem como possíveis caminhos à sua regulação e transmissibilidade, apontando para o uso do testamento e da analogia para superar lacuna normativa encontrada.
Many digital topics have legislation around the world, but in Brazil this reality is not the case, despite the emergence of some normative drafts in this scenario. Therefore, the objective of this work focuses on investigating the hereditary succession of so-called digital assets, which bring together notions of an existential and patrimonial nature. In this sense, digital inheritance is the verification that the deceased leaves not only fungible, tangible, substantial things, but also non-fungible goods, which is the central theme of this research. The methodology used was a bibliographic review, with an analytical focus on legal literature, norms, and jurisprudence. As results, the conceptualization of digital assets, their characteristics, and classifications, as well as possible paths to their regulation and transmissibility were highlighted, pointing to the use of will and analogy to overcome the normative gap found.
