| dc.description.abstract | This present monographic work has as an objective to analyse the requirements of the declaration of post mortem socio-affective afilliation, in the absence of a law regulating it. With the promulgation of the 1988 Federal Constitutional, the complete equality was stablished between the children. The principles of human dignity and the affectivity began to regulate family relantionships. Therefore, it is important to study about the origin of afilliation, from the beginning, stepping on the biological bond, until the current constitutionalized situation, the viability of civil entail, which, even involve coexistence. The search begins with the study of the guiding principles of the Family Law, as the varied types of family. In the next chapter, it is studied the historic evolution of families, as well the legislative developments about the same topic, being then studied the determining criteria for recognition of the socio-affective afilliation and the ways that could be performed. At the end, a specific doctrinal and jurisprudential analisys will be carried out about the recognition of the post mortem socio-affective afilliation. | en |
| dc.description.abstract | A presente monografia tem por objetivo analisar os requisitos da decretação de filiação socioafetiva post mortem, diante da ausência de norma que a regule. Com a promulgação da Constituição Federal de 1988, estabeleceu-se a completa igualdade entre os filhos. Os princípios da dignidade da pessoa humana e da afetividade passaram a regular as relações familiares. Portanto, imperioso o estudo acerca da origem da filiação, desde seu princípio, calcado no vínculo biológico, até a atual conjuntura constitucionalizada, da viabilidade de vínculos civis, que, inclusive comportam coexistência. A pesquisa se inicia com o estudo dos princípios norteadores do Direito de Família, como também os variados tipos de família. No capítulo seguinte, é estudada a evolução histórica das famílias e a evolução legislativa acerca do mesmo tema, sendo, também, abordados os critérios determinantes para o reconhecimento da filiação socioafetiva e as formas que poderão ser realizados. Ao final, realizar-se-á análise doutrinária e jurisprudencial específica, evidenciando os pressupostos do reconhecimento da filiação socioafetiva post mortem. | pt_BR |
