Resumo
Esta pesquisa insere-se na linha de pesquisa Educação, História e Política do
Programa de Pós-Graduação em Educação da Universidade do Sul de Santa
Catarina. Vinculada ao grupo de estudos e pesquisas em Políticas Públicas para
Educação Básica, História, Alfabetização e Letramento – GEPPHALE. Possui como
problemática de pesquisa: “partindo do marco legal, como o direito à educação infantil
materializa-se na educação pública, no Município de Tijucas (SC)?” Possui como
objetivo geral investigar como o direito à educação infantil materializa-se na educação
pública, no Município de Tijucas/SC, desdobrando-se nos seguintes objetivos
específicos: a) descrever como o direito à educação infantil está assegurado, nos
documentos oficiais do Município de Tijucas/SC; b) identificar quais são os critérios
de acesso às creches, nesse Município; e, c) verificar se as condições da qualidade
do atendimento ao direito à educação infantil estão sendo asseguradas às crianças
de Tijucas/SC. A base teórico-metodológica adotada, no estudo, para a análise,
fundamenta-se na abordagem materialista histórico-dialética. No que concerne ao
percurso metodológico, quanto aos procedimentos de coleta de dados, foram
utilizadas as pesquisas bibliográfica e documental, com abordagem qualitativa. O
percurso analítico foi realizado a partir de autores que tratam do direito à educação
infantil e das políticas públicas educacionais direcionadas à educação infantil, tais
como: Ariès (1986), Carvalho (2002), Cohn (2005) Gonçalves (2016), Heywood
(2004), Kramer, (2003), Kuhlmann (1998;1999), Libâneo (2004; 2012; 2018), Marchi
(2005), Oliveira, (2005), Sarmento (2007), Sarmento e Pinto (1997), Saviani (2008;
2011; 2013), entre outros. A partir da análise dos dados, verificou-se que a Lei
Complementar nº 45/16 do Município de Tijucas/SC traz as dimensões do cuidado e
da educação como indissociáveis, orientadas pelas perspectivas do princípio do
direito e da proteção integral da criança. Quanto ao Plano Municipal de Educação (Lei
nº 2599/2015), a meta 1 prevê um aumento de 35%, percebeu-se que o Município não
conseguiu atender integralmente à demanda para o período integral, no ano de 2022.
Para o período parcial, os documentos públicos disponíveis não informam a respeito
da quantidade de vagas disponíveis nos Centros de Educação Infantil, nem mesmo
quantas crianças não foram atendidas nesse ano. Observou-se, também, que o PPP
do Município está desatualizado, datado de 2020, o que possui desdobramentos
substanciais em relação à qualidade do atendimento. Além disso, o direito à Educação
Infantil para todas as crianças fica relativizado, porque é exigido que os pais trabalhem
de forma integral, o que pode solidificar a ideia de assistencialismo. Também foi
possível constatar que o direito à educação infantil, de acordo com o que preconiza o
marco legal, no Município de Tijucas/SC, ainda não se efetivou integralmente,
considerando que esse direito vai além da presença da criança nos Centros de
Educação Infantil. São dados, ainda, preliminares, já que o PME é até 2024. Por fim,
esta pesquisa reafirma a importância da luta em defesa de uma Educação infantil
pública e de qualidade.
This research is part of the research line Education, History and Politics of the Graduate Program in Education at the University of Southern Santa Catarina. Linked to the study and research group on Public Policies for Basic Education, History, Literacy and Literacy – GEPPHALE. It has as a research problem: “starting from the legal framework, how does the right to early childhood education materialize in public education, in the Municipality of Tijucas (SC)?”. Its general objective is to investigate how the right to early childhood education materializes in public education in the municipality of Tijucas (SC). This unfolded into the following specific objectives: a) describe how the right to early childhood education is ensured, in the official documents of the Municipality of Tijucas (SC); b) identify the criteria for access to day care centers in that municipality; and, c) verify whether the quality of care for the right t o early childhood education is being ensured for children in Tijucas (SC). The theoreticalmethodological basis adopted, in the study, for the analysis, is based on the historicaldialectical materialist approach. With regard to the methodological route, bibliographic and documentary research with a qualitative approach to the data was adopted. The analytical path was carried out from the authors who contributed to this research, among which some that deal with the right to early childhood education and educational public policies aimed at early childhood education stand out, such as: Ariès (1986), Carvalho (2002), Cohn (2005) Gonçalves (2016), Heywood (2004), Kramer, (2003), Kuhlmann (1998;1999), Libâneo (2004; 2012; 2018), Marchi (20 05), Oliveira, (2005), Sarmento (2007), Sarmento e Pinto (1997), Saviani (2008; 2011; 2013), between others. From the data analysis, it was verified that Law nº 45/16 brings the dimensions of care and education as inseparable, guided by the perspectives of the principle of law and the integral protection of the child. As for the Municipal Education Plan (Law nº 2599/2015), target 1 foresees an increase of 35%, it was noticed that the municipality was unable to fully meet the demand for the full period, in the year 2022. For the part-time, the available public documents do not inform about the number of vacancies available in the Early Childhood Education Centers, nor even how many children were not served that year. It was also observed that the Municipality's PPP is outdated, dated 2020, which has substantial consequences in relation to the quality of care. In addition, the right to Early Childhood Education for all children is relativized, because parents are required to work full-time, which can solidify the idea of assistance. It was also possible to verify that the right to early childhood education, in accordance with the legal framework, in the Municipality of Tijucas/SC, has not yet been fully realized, considering that this right goes beyond the presence of the child in the Education Centers Childish. These are still preliminary data, since the PME is until 2024. Finally, this research reaffirms the importance of the fight in defense of a public and quality Early Childhood Education.
