Monografia Acesso aberto Aeronaves remotamente pilotadas e a responsabilidade civil e penal: a eficácia da legislação atual brasileira para coibir o emprego irresponsável de aeronaves remotamente pilotadas e a segurança operacional de voo da aviação civil(2018) Chaves, Newton DuarteThis work was carried out based on the reading of documents, articles, portarias and videos, almost all coming from the internet. The general objective of this research was to analyze whether there is, among the currently existing norms, efficacy regarding the responsible use of Remotely Piloted Aircraft (ARP) in Brazil, in order to curb the irregular use of ARP, particularly in the vicinity of aerodromes and airports, avoiding the occurrence of accidents and / or incidents involving this equipment and aircraft operating with humans on board. The specific objectives were to identify the human, social and economic factors that could contribute to the irresponsible use of ARP and to identify the measures that could collaborate with the legislation produced by the Aeronautics Command through the Air Space Control Department (DECEA), the National Civil Aviation Agency (ANAC) and the National Telecommunications Agency (ANATEL), for the more efficient control of the responsible use of RPA in the vicinity of the aerodromes, as well as by the Brazilian Justice in the accountability of irresponsible users, or without adequate RPA training. In this regard, the research focused on the analysis done by specialists on the growth of RPA employment, on the diversification of the use of this equipment that has attracted small, medium and large entrepreneurs to the search for a market share. Observations were made on analyzes of the ease of acquisition of the various RPA models. Finally, it was sought to verify based on Law No. 7,565 / 86 - Brazilian Aeronautical Code, Aeronautical Command Instruction - Aeronautical Command Instruction - ICA 100-40, DECEA, in the Brazilian Civil Aviation Special ANAC and in articles and materials produced in the works carried out by scholars, among them the Brazilian Bar Association, which involve the use of drones and law, the possibility of improvements that may be inserted in the legislation, in order to further inhibit the irresponsible use of RPA.
