The proposed study aims to analyze the situation of the Brazilian prison population, more specifically, those with physical disabilities. For the elaboration of the work was used as scientific methodology the deductive mode, having been delimited the objective through research through the exploratory study. Data were collected through bibliographic and documentary research. The first chapter dealt with the conceptualization of persons with disabilities in general, as well as the explanation of their constitutional guarantees and the concept and necessity of the so-called accessibility. In the second chapter was made the approach about the prison system in Brazil, the historical evolution of the prison system, conceptualization of punishment, its purpose and characteristics, as well as the evolution of the different types and applications of sentences, in addition to the constitutional and infraconstitutional guarantees of arrested. The third chapter will deal with the fundamental rights of the disabled inmates and the responsibility of the state, as well as the real prison situation of the disabled inmates
