Resumo
A dissertação encerra um estudo interdisciplinar referente à história do constitucionalismo brasileiro através da Literatura. O objetivo principal foi demonstrar o potencial da Literatura para a
compreensão do processo de constitucionalização nacional, lançando mão do conceito nietzschiano do ressentimento como chave de leitura. Articulam-se as ficções de Machado de Assis, Graciliano Ramos e Guimarães Rosa, que apresentam, alegoricamente, um panorama da formação do Estado-nação nacional, desde a Independência à ditadura civil-militar-empresarial de 1964-1987, enquanto inscrevem simbolicamente os traumas e descontinuidades do nosso processo de constitucionalização. A dissertação conclui que através destas ficções tomamos ciência do verdadeiro pacto social que constitui a sociedade brasileira: o pacto entre os juristas e o modo de reprodução social escravista, que naturaliza uma tradição cordial de exercício do poder político da qual resulta, por sua vez, um profundo ressentimento social, relativizador dos preceitos
constitucionais.
The dissertation concludes an interdisciplinary study concerning the history of Brazilian constitutionalism through literature. The main objective was to demonstrate the literature's potential for understanding the national constitutional process, using the Nietzschean concept of resentment as a key of reading. The fictions of Machado de Assis, Graciliano Ramos and Guimarães Rosa, which allegorically present a picture of the formation of the national nation-state, from Independence to the civil-military-business dictatorship of 1964-1987, symbolizes traumas and discontinuities of our constitutional process. The dissertation concludes that through these fictions we become aware of the true social pact that constitutes Brazilian society: the pact between jurists and the mode of slave social reproduction, which naturalizes a cordial tradition of exercising political power, which, in turn, produces a deep social resentment, relativizing the constitutional precepts.
