Resumo
Essa pesquisa tem como objetivo analisar o tráfico humano com ênfase no princípio da dignidade da pessoa humana à luz do direito positivo brasileiro e no trabalho decente. Elencado no primeiro artigo da Constituição da República Federativa do Brasil, se faz necessário em um primeiro momento realizar uma contextualização histórica acerca do referido princípio, compreendendo sua origem e conceituação nos dias atuais. Em seguida se examinará o trabalho decente de acordo com a resolução de nº 8 da Agenda 2030 da Organização as Nações Unidas e a declaração da Organização Internacional do Trabalho sobre princípios e direitos fundamentais do trabalho. Por fim, se investigará o tráfico de pessoas por meio de legislação nacional e estrangeira, crime organizado transnacional altamente lucrativo que também é conhecido como uma forma de escravidão moderna e que faz milhares de vítimas todos os dias, averiguando suas diversas modalidades e o que o Brasil tem desempenhado para combater essa prática.
This research aims to analyze human trafficking with emphasis on the principle of human dignity in the light of Brazilian positive law and decent work. Listed in the first article of the Constitution of the Federative Republic of Brazil, it is first necessary to carry out a historical contextualization of the principle, understanding its origin and conceptualization today. Next, decent work will be examined in accordance with Resolution 8 of the 2030 Agenda of the United Nations and the International Labor Organization declaration on fundamental principles and rights of work. Lastly, the human trafficking will be investigated through national and foreign legislation, a highly profitable transnational organized crime that is also known as a form of modern slavery and which causes thousands of deaths every day, investigating its various modalities and what Brazil has done to combat this practice.
