Resumo
O presente trabalho tem por objetivo o estudo da síndrome de Burnout e suas consequências no âmbito do Direito do Trabalho. Analisa sob o prisma político-econômico a incidência da síndrome de Burnout no empregado, e como a negligência da manutenção do meio ambiente de trabalho por parte do empregador é a peça principal para que isso ocorra. Realiza, também, abordagem histórica do tema, demonstrando a evolução da tutela e proteção jurídica ao empregado ao longo do tempo em um sistema econômico capitalista, onde a produção é priorizada em detrimento da saúde física e mental dos trabalhadores. Objetiva, portanto, analisar, conceituar e demonstrar através de pesquisa doutrinária e jurisprudencial, o enquadramento legal e as consequências decorrentes da síndrome de Burnout no contrato individual do trabalho e na sociedade.
The present work aims to study the Burnout syndrome and its consequences in the scope of Labor Law. It analyzes from a political-economic perspective the incidence of Burnout syndrome in the employee, and how the employer's negligence in maintaining the work environment is the main part for this to occur. It also performs a historical approach to the subject, demonstrating the evolution of guardianship and legal protection to the employee over time in a capitalist economic system, where production is prioritized to the detriment of the physical and mental health of workers. It aims, therefore, to analyze, conceptualize and demonstrate, through doctrinal and jurisprudential research, the legal framework and the consequences arising from the Burnout syndrome in the individual contract of work and in society.
