Resumo
O presente trabalho tem como objetivo fazer uma análise do que é identidade
de gênero e apresentar a necessidade da retificação do registro civil das pessoas
transsexuais/travestir. Para isso foi feita uma análise da evolução dos direitos LGBT+
assim como as diversas conquistas legais, como a união homoafetiva. Também é
apresentado o conceito de transexuais , identificando suas características psicológica
e a diferença entre sexualidade e identidade de gênero assim como o
reconhecimento da dignidade da Pessoa humana e os Direitos Fundamentais. Por
fim é feito pesquisa buscando em nosso ordenamento jurídico leis e jurisprudências
que visam atuar nas questões relativas aos transexuais, como a autorização da
cirurgia redesignação de gênero e a alteração do registro civil e utilização do nome
social. Faz necessário assegurar a igualdade legal para todos os indivíduos em nossa
sociedade, garantindo a aplicabilidade legal e o reconhecimento da pessoa trans como
individuo de pleno direito e garantias constitucionais.
The present work aims to analyze what gender identity is and present the need to rectify the civil registration of transsexuals / transvestites. for this, an analysis was made of the evolution of LGBT+ rights as well as the various legal achievements, such as the same-sex union. The concept of transsexuals is also presented, identifying their psychological characteristics and the difference between sexuality and gender identity, as well as the recognition of human dignity and Fundamental Rights. Finally, research was carried out, seeking in our legal system laws and jurisprudence that aim to act on issues related to transsexuals, such as the authorization of gender reassignment surgery and the alteration of the civil registry and use of the social name. it is necessary to ensure legal equality for all individuals in our society, guaranteeing the legal applicability and recognition of the trans person as an individual with full rights and constitutional guarantees.
