Teletrabalho e direito à desconexão: a regulamentação legal dos institutos antes e durante a pandemia e o futuro legislativo

Resumo
O presente estudo analisa o teletrabalho e o direito à desconexão. Sua relevância
se traduz na mudança paradigmática ocorrida em decorrência da pandemia de
COVID-19 que ocasionou uma migração em massa ao regime de teletrabalho.
Aponta a relação dos dois institutos e indica se há ou não legislação satisfatória que
regule os dois pontos. Também apresenta algumas perspectivas legislativas futuras.
Para tanto, é preciso apresentar conceitos básicos como o de teletrabalho
(apontando, inclusive, sua evolução histórica), e especificar como a jornada se dá
para o teletrabalhador conforme disposto na Consolidação das Leis do Trabalho.
Apresenta o conceito do que seria o direito à desconexão e seus impactos na saúde
do teletrabalhador, além de apontar possíveis consequências de seu
descumprimento (dano existencial e horas de sobreaviso). Por fim, analisar das
legislações pertinentes, o que inclui as mudanças promovidas pela Lei 13.467/2017
(Reforma Trabalhista) e as Medidas Provisórias editadas de enfrentamento da
pandemia. Também se buscou apresentar e mencionar os Projetos de Lei relevantes
que tratem do assunto e que se encontram em tramitação no Congresso Nacional.
Ao final, conclui-se pela ausência de regulamentação satisfatória dos institutos,
mesmo com as mudanças que decorreram da superveniência da pandemia de
COVID-19. O procedimento e metodologia adotados foram a de pesquisa
bibliográfica e legislativa, por meio da pesquisa em bibliotecas, tanto física como
digitais de livros, artigos científicos, publicações em periódicos, entre outros.
The present study analyzes teleworking and the right to disconnect. Its relevance is reflected in the paradigm shift that took place as a result of the COVID-19 pandemic that caused a mass migration to telework. It points out the relationship between the two institutes and indicates whether or not there is satisfactory legislation that regulates the two points. It also presents some future legislative perspectives. To do so, it is necessary to present basic concepts such as telework (pointing out its historical evolution), and specify how the teleworker's journey takes place, as provided for in the Consolidation of Labor Laws. It presents the concept of what the right to disconnect would be and its impacts on the health of teleworkers, in addition to pointing out possible consequences of non-compliance (existential damage and hours of on-call). Finally, analyze the relevant legislation, which includes the changes promoted by Law 13.467/2017 (Labor Reform) and the Provisional Measures edited to face the pandemic. It was also sought to present and mention the relevant Bills that deal with the subject and that are being processed in the National Congress. In the end, it is concluded by the absence of satisfactory regulation of the institutes, even with the changes that resulted from the supervenience of the COVID-19 pandemic. The procedure and methodology adopted were bibliographic and legislative research, through research in libraries, both physical and digital, of books, scientific articles, publications in journals, among others.
