Resumo
Em 2022 a Carta das Nações Unidas completa 77 anos, tendo como objetivo
principal objetivo a manutenção da paz, composição de conflitos sem o uso da força
com a cooperação e progresso dos povos e principalmente da proteção dos Direitos
Humanos. No entanto, esta não é a situação vivenciada no cenário mundial, onde
convivemos com diversos conflitos que destroem milhares de vidas ano após ano.
Desta forma, o presente trabalho se propõe avaliar através de uma revisão histórica,
a construção jurídica das principais atribuições do Conselho de Segurança e o
instituto do poder de veto, buscando entender o porquê a configuração atual não tem
funcionado, especialmente no caso do conflito Rússia x Ucrânia. A partir de uma
pesquisa descritiva, com base em fontes secundárias e uma revisão bibliográfica, o
texto demonstra que o Conselho de Segurança da ONU é propositalmente
ineficiente por uma variedade de motivos políticos das grandes potências, sendo
fundamental que haja uma reforma na Carta das Nações Unidas para que se
diminua, de maneira realista, as desigualdades e que a instituição venha a se
comportar de acordo com os preceitos da CNU e do Direito Internacional.
In 2022 the UN Charter completes 77 years, having as a primary goal the maintenance of peace, the non-violent resolution of conflicts, cooperation and progress of the people, and mainly of Human Rights. However, this is not the situation in today in the world community, as we live surrounded by conflicts that destroy millions of lives yearly. Therefore, this paperwork proposes an evaluation through a legal and historical revision of the construction of the main attributions from the Security Council and the veto power institute, seeking to understand why the current setup is not working, especially in solving the Russian x Ukraine conflict. Based on descriptive research, secondary sources, and a bibliographic review, the text demonstrates that the UN Security Council is deliberately inefficient for various reasons that come from the great power countries. Therefore, it is fundamental that there be a reform in the UN Charter so that the inequalities can be, realistically, reduced and that the institution behaves by the precepts of the Charter and International Law.
