Resumo
A luz dos conceitos da senciência animal que fundamentou a PLC 27/2018, estabelecendo natureza jurídica sui generis e passando atribuir a dignidade animal. Esse estudo objetivou indagar e compreender a razão ainda existente das ocorrências de perdas e mortes de animais em transportes e a falta de sua regulamentação. Verificou-se que a emblemática se dá porque animais ainda são considerados como cargas, objetos e bens móveis. O que viabiliza os maus tratos e a falta de responsabilidade das empresas de transportes. Analisou-se a norma constitucional e infraconstitucional, com o objetivo de constatar se a senciência animal se encontra resguardada no ordenamento legal. Como forma alternativa de destacar a importância da preservação animal, verificou- se projetos com a finalidade de garantir e resguardar a dignidade animal no transporte, viabilizando afável relação entre companhias de transportes e clientes, conquistando mais um avanço civilizacional, que ainda precisa de empenho da sociedade e poder público para sua efetivação e abolição de maus tratos.
In the light of the concepts of animal sentience that founded the PLC 27/2018, establishing a sui generis legal nature and starting to attribute animal dignity. This study aimed to investigate and understand the reason that still exists for the occurrence of losses and deaths of animals in transport and the lack of its regulation. It was found that the emblem happens because animals are still considered loads, objects, and movable goods. This makes the mistreatment and lack of responsibility of transport companies possible. The constitutional and infra-constitutional norm was analyzed, to verify if the animal sentience is protected in the legal system. As an alternative way of highlighting the importance of animal preservation, there were projects to guarantee and protect animal dignity in transport, enabling an affable relationship between transport companies and customers, achieving yet another civilizational advance, which still needs commitment from society and public power for its effectiveness and abolition of mistreatment.
