Resumo
O objetivo deste trabalho foi analisar o mecanismo da prioridade de tramitação para idosos e
pessoas com deficiência e demonstrar que este deveria ser concedido de ex officio àqueles que a
ele têm direito. Para isso, utilizamos o método monográfico qualitativo, o qual parte do princípio
de que o estudo de um caso em profundidade pode representar casos semelhantes. Baseamo-nos
nas contribuições de autores como Marco Aurélio Serau Jr., José Antonio Savaris e Miguel Reale
para avaliar a questão sob diversas óticas, desde as origens da prioridade de tramitação até sua
relação com a teoria tridimensional do direito. Além disso, apresentamos casos nos quais o
benefício estudado seria crucial para equilibrar as assimetrias entre litigantes habituais e
essenciais, corroborando nossa hipótese. Conclui-se que, de acordo com a bibliografia e os casos
estudados, a prioridade de tramitação é um importante recurso para a busca por honrar os direitos
fundamentais firmados pela Constituição Federal.
The purpose of this paper was to analyze the priority processing mechanism for the elderly and people with disabilities and to demonstrate that this should be granted ex officio to those who are entitled to it. To this end, we used the qualitative monographic method, which assumes that the study of a case in depth can represent similar cases. We based ourselves on the contributions of authors such as Marco Aurélio Serau Jr., José Antonio Savaris and Miguel Reale to evaluate the issue from different perspectives, from the origins of priority processing to its relationship with Reale’s three-dimensional theory of law. In addition, we present cases in which the studied benefit would be crucial to balance the asymmetries between habitual and essential litigants, corroborating our hypothesis. In conclusion, according to the bibliography and the cases studied, the priority of processing is an important resource in the quest to honor the fundamental rights established by the Federal Constitution.
