A admissibilidade do direito ao esquecimento no Brasil à luz da CRFB/88: Critérios para o sopesamento entre os direitos da personalidade e a liberdade de expressão

Resumo
Sob uma ótica analítica, o presente projeto traz em seu cerne os encadeamentos do direito ao esquecimento no cenário jurisprudencial brasileiro. O artigo contemplará os posicionamentos heterogêneos acerca daquele na jurisprudência pátria, bem como as implicações decorrentes do reconhecimento de tal instrumento. Outrossim, abranger-se-á o liame entre o direito supramencionado e o direito à identidade, privacidade e intimidade, especialmente no tocante ao exercício desses preceitos nos meios digitais de comunicação. Ademais, dar-se-á enfoque ao dilema entre o direito ao esquecimento e às liberdades de expressão, informação e de imprensa; do mesmo modo, investigar-se-á, por meio de consulta bibliográfica e jurisprudencial, as nuances observadas como parâmetros para a ponderação judicial sobre os direitos alhures aludidos. Nessa oportunidade, apurar-se-á a repercussão da decisão do Supremo Tribunal Federal no RE 1.010.606/RJ, de 2021 (tema 786), a qual entendeu pela incompatibilidade do direito ao esquecimento com o bojo do texto constitucional; a decisão em comento teve um desfecho destoante ao entendimento adotado anteriormente pelo Superior Tribunal de Justiça no Recurso Especial n. 1.334.097/RJ – caso "Chacina da Candelária". Destarte, o artigo não isentar-se-á de empregar meios para propiciar o deslinde sobre os fundamentos do direito ao esquecimento no Brasil, isto é, o trabalho propõe-se a um estudo ontológico no que concerne a natureza autônoma ou decorrente – de direitos positivados – do direito ao esquecimento.
From an analytical perspective, this project brings at its core the chains of the right to be forgotten in the Brazilian jurisprudential scenario. The article will contemplate the heterogeneous positions about that in the national jurisprudence, as well as the implications arising from the recognition of such an instrument. Furthermore, the link between the aforementioned right and the right to identity, privacy and intimacy will be covered, especially with regard to the exercise of these precepts in digital means of communication. Furthermore, it will focus on the dilemma between the right to be forgotten and freedom of expression, information and the press; in the same way, it will be investigated, through bibliographical and jurisprudential consultation, the nuances observed as parameters for the judicial weighting on the rights mentioned elsewhere. On that occasion, the repercussion of the decision of the Federal Supreme Court in RE 1.010.606/RJ, of 2021 (theme 786), which understood the incompatibility of the right to be forgotten with the bulge of the constitutional text; the decision under discussion had an outcome that was inconsistent with the understanding previously adopted by the Superior Court of Justice in RE 1.334.097 – “Candelária Massacre”. Thus, the article will not exempt itself from employing means to provide a solution to the foundations of the right to be forgotten in Brazil, that is, the work proposes an ontological study with regard to the autonomous or resulting nature – of rights positive – from the right to be forgotten.
