O direito à saúde mental dos trabalhadores brasileiros no contexto de precarização pós-reforma de 2017

Resumo
O objetivo deste trabalho é verificar se, e em que medida, a Lei nº 13.467/17,
popularmente conhecida como Reforma Trabalhista, pode impactar no direito à saúde
mental dos trabalhadores. A base teórica utilizada para a construção da pesquisa é a
metateoria do direito fraterno. A pesquisa realizada observa o método qualitativo em
análise a 25 processos oriundos das duas varas especializadas em acidente do
trabalho no âmbito do Tribunal Regional do Trabalho da 4ª Região, quais sejam, a 30ª
vara do trabalho de Porto Alegre e a 6ª vara do trabalho de Caxias do Sul. Os 25
processos em questão foram analisados para identificar as causas apontadas para o
adoecimento mental dos trabalhadores pelos peritos médicos nomeados e pelos
magistrados em 1º e 2º graus que julgaram as demandas, além do estabelecimento
ou não de nexo direto ou indireto dessas patologias com o trabalho. Os resultados
demonstram a sobrecarga de trabalho como a principal causa de adoecimento mental
dos trabalhadores nos últimos 10 anos, circunstância essa amplamente alargada
pelas alterações legislativas promovidas pela Reforma Trabalhista. Como
contribuição, espera-se relembrar da importância de um olhar fraterno também nas
relações de trabalho, para que se resgate o outro esquecido que, nesse caso, é a
condição humana de quem trabalha.
The objective of this work is to verify if, and to what extent, Law nº 13.467/17, popularly known as Labor Reform, can impact the right to mental health of workers. The theoretical basis used for the construction of the research is the metatheory of fraternal law. The research carried out will observe the qualitative method in analysis of 25 cases arising from the two courts specialized in occupational accidents within the scope of the Regional Labor Court of the 4th Region, that is, 30th labor court of Porto Alegre and 6th labor court of Caxias do South. The 25 cases in question were analyzed to identify the causes indicated for the mental illness of the workers by the appointed medical experts and by the magistrates in the 1st and 2nd degrees who judged the demands, in addition to the establishment or not of a direct or indirect link between these pathologies and work. The results show that the main cause of mental illness among workers in the last 10 years was work overload, a circumstance that was broadly extended by the legislative changes promoted by the Labor Reform. As a contribution, it is expected to remember the importance of a fraternal look also in work relationships, so that the forgotten other is rescued, which, in this case, is the human condition of those who work.
