Resumo
Este artigo aborda a Violência Obstétrica e a Falta de Humanização na Hora do Parto, tratando-se de uma análise jurídica a respeito da Responsabilidade Civil dos agentes causadores como fator essencial a coibição do ilícito praticado. Esse tema se mostra importante porque no ordenamento jurídico brasileiro ainda não existe uma lei específica para tal contexto, porém, no âmbito civil existe a responsabilização civil para quem pratica esse ato ilícito. Portanto, resta demonstrar que a violência obstétrica e a falta de humanização na hora do parto são assuntos preocupantes e importantíssimos que afetam muitas mulheres em todo o mundo. Nesse contexto, torna-se
fundamental abordar a temática e avaliar possíveis mecanismos de responsabilização civil dos agentes causadores dessa violação.
This research addresses Obstetric Violence and the Lack of Humanization at the Time of Birth, in the case of a legal analysis regarding the Civil Liability of agents causes as an essential factor in preventing the illicit activity committed. This topic is important because in our legal system there is still no specific law for such a context, however, in the civil sphere there is civil liability for who carries out this illicit act. Therefore, it remains to be demonstrated that obstetric violence and the lack of humanization during childbirth are worrying and extremely important issues that affect many women around the world. In this context, it is essential to address the issue and evaluate possible mechanisms for civil liability of the agents causing this violation.
