Resumo
O presente estudo tem como objetivo verificar a possibilidade jurídica de concessão do
benefício previdenciário da aposentadoria por incapacidade permanente ao segurado que seja
viciado em tóxico, principalmente crack e cocaína e derivados, devidamente diagnosticado por
meio da CID-10 ou do DSM-V. A metodologia utilizada é de abordagem qualitativa, com nível
exploratório, tendo sido viabilizada por pesquisa bibliográfica, da literatura científica
psiquiátrica, psicológica e jurídica e documental, da legislação aplicável, de dados públicos
oficiais e de precedentes relativos ao tema. O resultado verificado no terceiro capítulo de
desenvolvimento, depois de análise de literatura cientifica e das hipóteses normativas de
incidência da Lei n.º 8.213/91, interpretada em conjunto com as normas aplicáveis, é de que o
segurado dependente químico que seja reincidente no uso de substâncias e que não tenha
possibilidade de readaptação no mercado de trabalho tem direito à concessão da aposentadoria
por incapacidade permanente. Assim conclui-se pela possibilidade jurídica e pelo direito do
segurado viciado em tóxico à concessão do benefício.
The present study aims to verify the legal possibility of granting the pension benefit for permanent disability retirement to the insured who is a chemically dependent addict, especially in crack and cocaine, based on the ICD-10 or DSM-V. The methodology used is of a qualitative approach, in an exploratory level, having been made possible by bibliographical research of psychiatric, psychological and legal scientific literature, and documentary research of applicable legislation, official public data, and of judicial precedents related to the subject. After the analysis of the scientific literature and the normative hypotheses of incidence of Law No. 8.213/91, we concluded that the chemically dependent who is protected by social insurance, who has relapsed several times in the abuse of substances, and who has no possibility of readaptation in the labor market is entitled to be granted retirement due to permanent incapacitation. Thus, we conclude for the legal possibility and for the right of the insured addicted to drugs to be granted the social retirement benefit.
