| dc.description.abstract | O presente estudo abordou o tema da responsabilidade civil na sociedade da informação quando a vítima tem seus direitos de personalidade ofendidos em virtude da prática das variações do bullying. Para isto, foram analisados os institutos de responsabilidade civil contidos no Código Civil e a fixação do quantum indenizatório nestas lides, bem como, a obrigação do Estado zelar pelos direitos de personalidade dos envolvidos nas diversas variações de bullying. O método utilizado foi o dedutivo, partindo de uma premissa maior, que é a responsabilidade civil na sociedade da informação, passando por uma breve análise dos projetos de lei que tramitam na Câmara dos Deputados e que versam sobre o bullying e suas variações, verificando também, a quantificação e valoração do dano moral percebido pelas vítimas das práticas de bullying. A pesquisa utilizada no presente trabalho foi a bibliográfica, com a utilização de livros, artigos jurídicos impressos e/ou publicados na internet, bem como, de jurisprudências de diversos tribunais. Assim, conclui-se com este trabalho que o bullying e suas variações, apesar de ser um fenômeno não tão recente, ainda não possui legislação específica vigente, por este motivo os tribunais utilizam da analogia para a reparação dos danos à personalidade das vítimas de tais afrontas, bem como, com a era da sociedade da informação a prática deste fenômeno é cada vez mais frequente, devendo a legislação brasileira adaptar-se e verificar o dano sofrido pela vítima, para assim fixar o quantum indenizatório de cada lide. | pt_BR |
| dc.description.abstract | The present study addressed the issue of liability in the information society when the victim has offended their personal rights by virtue of the practice of the variations of bullying. For this, we analyzed the institutes of civil liability contained in the Civil Code and the determination of these quantum indemnity disputes, as well as the state's obligation to protect the rights of the personality involved in several variations of bullying. The deductive method was used, from a major premise, which is a liability in the information society, through a brief analysis of the bills processed by the House of Representatives and that deal with bullying and its variations, and to verify the quantification and valuation of pain and suffering felt by victims of bullying practices. The survey used in this study was the literature, with the use of books, articles, legal forms and / or published on the Internet, as well as the jurisprudence of various courts. In conclusion, this work was that bullying and its variations, although not as recent a phenomenon not yet have specific legislation in force, for this reason the courts use the analogy for the repair of damage to the personality of the victims of such insults as well, with the era of information society the practice of this phenomenon is becoming increasingly common, with the Brazilian legislation to adapt and check the damage suffered by the victim, so as to fix the quantum of each severance deal. | en |
