Resumo
Este artigo tem por objetivo demonstrar a necessidade da criação de uma tutela jurídica em defesa dos animais, como sendo sujeitos de direitos fundamentais, que precisam ser especificadamente protegidos sem que estejam submersos a direitos de outrem, de modo que
sua integridade seja significativamente considerada. A pesquisa adotará o método hipotético dedutivo, visto que tem como ponto principal demonstrar a adversidade em face da omissão legislativa ou a falta de regimento no que se refere a causa animal e as necessidades existentes conforme a evolução social, pois em face da lacuna existente pela omissão do conhecimento específico, perfaz o problema diante da sociedade, uma vez que as relações precisam ser regidas, de moto que não exista um vazio ao tratar de um fator preponderante.
This research aims to demonstrate the need for the creation of a legal protection in defense of animals, as subjects of fundamental rights, which need to be specifically protected without being submerged in the rights of others, so that their integrity is meaningfully considered. The research will adopt the hypothetical-deductive method, since its main point is to demonstrate the adversity in the face of the legislative omission or the lack of regiment with regard to the animal cause and the existing needs according to the social evolution, because in the face of the gap existing by the omission of specific knowledge, it makes up the problem before society, Since relationships need to be governed, there should be no emptiness when dealing with a preponderant factor.
