dc.description.abstractEste artigo tem por objetivo demonstrar a necessidade da criação de uma tutela jurídica em defesa dos animais, como sendo sujeitos de direitos fundamentais, que precisam ser especificadamente protegidos sem que estejam submersos a direitos de outrem, de modo que sua integridade seja significativamente considerada. A pesquisa adotará o método hipotético dedutivo, visto que tem como ponto principal demonstrar a adversidade em face da omissão legislativa ou a falta de regimento no que se refere a causa animal e as necessidades existentes conforme a evolução social, pois em face da lacuna existente pela omissão do conhecimento específico, perfaz o problema diante da sociedade, uma vez que as relações precisam ser regidas, de moto que não exista um vazio ao tratar de um fator preponderante.pt
