Extrajudicial services have the historical role of recording and documenting the civil and business acts of everyday life, and currently it has been a valid instrument for expanding and speeding succession acts. | dc.description.abstract | O direito sucessório é um ramo natural do direito, literalmente transcende a vida e está ligado de maneira indissociável ao ser humano e ao legado material deixado por estes, para que esse direito fosse assegurado necessitava-se amparo da Lei, e isso ocorreu, porém, muitas vezes a legislação impediu que tais direitos fossem realizados ou oficializados, e a evolução das normas foi tomando forma a medida em que a sociedade como um todo evoluiu. Com base na análise histórica e normativa desse instituto o trabalho irá verificar as funcionalidades e possibilidades abertas pelos instrumentos de sucessão possíveis no âmbito extrajudicial. As serventias extrajudiciais tem o papel histórico de gravar e documentar os atos civis e negociais da vida cotidiana, e, atualmente tem sido instrumento válido para ampliação e velocidade dos atos de caráter sucessório. A judicialização impõe lide, chancela de um juiz em situações imponderáveis, o processo administrativo dos cartórios em questão de inventários e sobrepartilhas demonstra que se há consenso entre os que tem direito a herdar, e capacidade civil não há razão de buscar outra via que não seja a extrajudicial. | pt_BR |
