Artigo Científico Acesso aberto O instituto da responsabilidade solidária na esfera administrativa diante do código brasileiro de aeronáutica(2019) Dias, Stella SilviaContent presented as work to complete the course management and aeronautical law focused on the study of administrative sanctions foreseen in the Brazilian Aeronautical Code (CBA). It presents the legitimacy of the administrative sanction by the aeronautical authority addressing the public interest, the administrative powers of the National Aviation Agency Civil (ANAC) and the premises of the sanctioning administrative process. It details the inspection activities under the authority of ANAC and presents the administrative measures adopted in case of noncompliance with the current legislation. It addresses the Institute of Solidarity and studies the possibility of the administration making use of it. It presents the scope and history of the judgments of the sanctioning processes of the Superintendency of Operational Standards – SPO of ANAC from 2016 to 2018. It interprets the administrative measures provided for in articles 299 and 302 of the CBA and analyzes the reports available in the “Fines and Infringements System - SMI” used by the ANAC agents for drawing up infraction notices with an emphasis on the analysis of the institute of solidarity to avoid possible excesses by the administration.Artigo Científico Acesso aberto A mudança do perfil de dominância cerebral na prevenção de acidentes aeronáuticos(2018) Tomita, Roberto KazuyoshiThe present work had as general objective to verify the possibility of reducing the amount of aeronautical accidents caused by human factors, applying the concepts of the cerebral dominance profile, formulated by Ned Herrmann, with possibilities of the changes of these profiles of the individuals and their attitudes. In order to achieve the research objective, the methodology used included bibliographical and documentary research in the definition of concepts of accidents, causative factors, in specifics, humans, and contextualization for aviation. The Brain Dominance Theory was guided by the concepts of Ned Herrmann and the Miranda updates. A study was carried out quantitative approach, through the application of a questionnaire. We worked with field research, in the application of a questionnaire for pilots who concluded, in 2018, the Course of Prevention of Aeronautical Accidents, of CENIPA to form a control group. Through the data collected, remarkable characteristics were observed, according to the concepts of Ned Herrmann and the dominant cerebral side of the pilots with flight safety doctrine. From the documentary research of the final reports of aeronautical accidents, human factors that caused accidents were chosen that were not in control group characteristics. The results allowed to conclude in the light of the theoretical reference and the psychometric tools that the outstanding characteristics of human factors that generate accidents in aviation can be identified and treated to mitigate the accidents and aeronautical incidents.Artigo Científico Acesso aberto A nova lei do aeronauta (Lei 13.475/17) e suas principais mudanças para tripulação de linha aérea(2019) Lobato, Carlos Augusto SoaresO estudo teve como objetivo geral identificar as principais mudanças trazidas pela lei do aeronauta n. 13.475 /17, bem como compreender quais foram os impactos para a tripulação de linhas aéreas. Para tanto foi feita uma revisão literária com base em pesquisa bibliográfica e documental, a abordagem de análise foi qualitativa. O estudo mostrou que as mudanças entre a antiga lei do aeronauta e nova lei do aeronauta estão especialmente relacionadas a limites de horas de voo e jornada de trabalho, bem como no aumento nas horas do descanso. Tendo em vista mudanças relacionadas a essas questões, podem impedir companhias aéreas brasileiras de realizar rotas internacionais mais longas. Com isso, fazendo as empresas estrangeiras a realizarem essas rotas ficando o tripulante brasileiro tendo sua remuneração limitada. The research undertaken addresses the theme of drones in the face of aeronautical safety based on Brazilian regulatory standards, to verify whether the existing regulation for the use of drones guarantees the safety of air traffic. Therefore, it is necessary to present the definitions of aeronautical law and national regulations on drones, analyze foreign legislation on the subject and, in the end, identify the points where national legislation should be improved. Then, bibliographical and documentary research is carried out, with sources in articles and doctrines of aeronautical law, as well as national and foreign norms regarding the subject. Therefore, it appears that national legislation is already well developed concerning foreign legislation so that foreign legislation also does not present regulations that guarantee airspace security and that inspection is more urgent than the modernization of legislation still under construction, which imposes the observation that the legislation for drone operations in Brazil still does not guarantee the safety of airspace due to the lack of inspection by the competent bodies.Artigo Científico Acesso aberto Sistema de aeronaves remotamente pilotadas (ARPs): legislação aplicável nas operações especializadas de inspeção de linhas de transmissão(2018) Santos Júnior, Jayme AlvesEste trabalho é um estudo da legislação que instrui a operação de Aeronaves Remotamente Pilotadas (ARPs). A pesquisa foi realizada na rede mundial de computadores, nos regulamentos nacionais e internacionais, em revistas eletrônicas e notícias envolvendo a construção e a operação das ARPs, e está direcionada para certificação de empresas operadoras de ARPs Classes 2 e 3, tendo por escopo a entrada em operação do Sistema de Aeronaves Remotamente Pilotadas (SARP), resultante do Projeto de Pesquisa e Desenvolvimento (P&D) desenvolvido para a empresa patrocinadora/cliente CELESC (Centrais Elétricas de Santa Catarina S.A.) e executado pelo INERGE (Instituto de Estudos e Gestão Energética). O projeto insere-se no programa de P&D da ANEEL (Agência Nacional de Energia Elétrica), em conformidade com a Lei nº 12.212, de 20 de janeiro de 2010. A CELESC, com 5.000 km de linhas de transmissão, dos 100.000 de praticamente todo o Brasil, é vital para o abastecimento de energia do país, por causa da interligação entre o Sistema Elétrico do Estado de Santa Catarina e do País. Qualquer queda ou problema em uma das linhas pode gerar transtornos e prejuízos à nação. A legislação da ANEEL prevê que as atividades mínimas de manutenção para as linhas de transmissão sejam feitas via inspeções terrestres e aéreas, e realizadas, no mínimo, a cada doze meses e em períodos não coincidentes. Por terra, em veículos ou a pé, são demoradas e exigem demais das equipes em função do relevo acidentado em várias regiões. Por helicópteros, há riscos potenciais e custos elevados. O uso das ARPs eliminaria as dificuldades e os custos financeiros elevados. Porém, há regulamentações não aprovadas, como as de registros, certificações e habilitações de empresas que queiram entrar no mercado. Algumas normas são experimentais, como o RBAC-E 94 (Regulamento Brasileiro da Aviação Civil), da ANAC (Agência Nacional de Aviação Civil), outras necessitam de mudanças, como a ICA 100-40 (Instrução do Comando da Aeronáutica), do DECEA (Departamento de Controle do Espaço Aéreo), que trata dos Sistemas de Aeronaves Remotamente Pilotadas (SARPs) e o Acesso ao Espaço Aéreo Brasileiro, e se deve cumprir a legislação emitida pela ANATEL (Agência Nacional de Telecomunicações), no que se refere às frequências de rádios empregadas para uso das ARPs. A área que está exigindo um empenho maior por parte dos órgãos reguladores, em todo o mundo, relaciona-se com a operação de ARPs Classes 1 e 2, uma vez que a Classe 3, que opera até a linha de visada do piloto remoto e abaixo de 400 pés (120 metros), está bem definida. Existem fabricantes, empresas e profissionais brasileiros interessados em fazer parte desse desenvolvimento tecnológico e de seu emprego comercial. Este trabalho tem por base o uso, em inspeção de linhas de transmissão, dos modelos FT 200FH, Classe 2, e FT 100FH, Classe 3, da FT Sistemas S.A., frutos do referenciado P&D.
