Resumo
O presente artigo tem como objetivo abordar a crise que vive o país no que tange a execução penal, relatando e analisando os dados que incidem sobre nosso sistema prisional. O enfoque do artigo é aprofundar nas causas e afirmativas que fundamentaram o Projeto de Lei 3171/15, que visava a extinção do regime semiaberto, bem como evidenciar as mudanças provocadas pela pandemia no mesmo. Diante das vertentes sobre o manejamento proposto pela lei, analisa-se, minuciosamente, suas justificativas e controvérsias e, por fim, indaga-se; o fim do semiaberto seria uma das soluções para os problemas relacionados a execução penal no Brasil? Ou a medida é apenas uma das inúmeras tomadas pelo poder legislativo de forma precipitada, e que afasta ainda mais a esperança da ressocialização?
This article aims to address the crisis that the country is experiencing with regard to criminal execution, reporting and analyzing the data that affect our prison system. The focus of the article is to go deeper into the causes and statements that founded the Bill 3171/15, which aimed at the extinction of the semi-open regime, as well as highlighting the changes caused by the pandemic in it. In view of the aspects of the management proposed by the law, its justifications and controversies are carefully analyzed and, finally, it is asked; Would the end of the semi-open be one of the solutions to the problems related to criminal execution in Brazil? Or is the measure just one of the countless measures taken by the legislature in a precipitous way, and which further pushes away the hope of resocialization?
