Resumo
O estudo monográfico tem por escopo discutir acerca dos aspectos jurídicos decorrentes das alterações introduzidas na Consolidação das Leis do Trabalho pela Lei nº 13.467, de 13 de julho de 2017, conhecida como Reforma Trabalhista. Assim, delimita-se à análise dos artigos 790-B, caput, § 4º, artigo 791-A, § 4º e artigo 844, § 2º, todos da Consolidação das Leis do Trabalho e discutir as consequências da mitigação da concessão do benefício da justiça gratuita à luz do princípio da inafastabilidade do controle jurisdicional. Trata-se de temática de grande relevo, na medida em que o acesso à justiça é um direito fundamental. A pesquisa classifica-se como indutiva, descritiva e bibliográfica. Constata-se que as alterações introduzidas na concessão do benefício da justiça gratuita e seus reflexos nos honorários de sucumbência e periciais é inconstitucional, na medida que mitiga o acesso à justiça e compromete a sua efetivação no Direito do Trabalho. Tal questão vinha gerando insegurança jurídica, até que recentemente o Supremo Tribunal Federal, em sede de controle concentrado de constitucionalidade, julgou parcialmente procedente a Ação Direta de Inconstitucionalidade nº 5.766, declarando inconstitucionais os artigos 790-B, caput, § 4º e artigo 791-A, § 4º, afastando as limitações e mitigação do acesso à Justiça do Trabalho.
The monographic study aims to discuss the legal aspects arising from the changes introduced in the Consolidation of Labor Laws by Law 13,467, of July 13, 2017, known as the Labor Reform. Thus, the analysis of articles 790-B, caput, § 4, article 791-A, § 4 and article 844, § 2, all of the Consolidation of Labor Laws, is limited to the discussion of the consequences of mitigating the granting of the benefit of free justice to light of the principle of inescapability of jurisdictional control. It is a matter of great importance, as access to justice is a fundamental right. The research is classified as inductive, descriptive and bibliographic. It appears that the changes introduced in the granting of the benefit of free justice and its effects on the loss of suit and expert fees is unconstitutional, as it mitigates access to justice and compromises its effectiveness in the Labor Law. This issue had been generating legal uncertainty, until recently the Federal Supreme Court, in the context of concentrated control of constitutionality, partially upheld the Direct Action of Unconstitutionality 5.766, declaring unconstitutional article the 790-B, caput, § 4, and article 791-A, § 4, removing the limitations and mitigation of access to the Labor Court.
