Monografia Acesso fechado Abandono afetivo e a não obrigação do filho abandonado de cuidar dos genitores durante a velhice(2020) Zabot, Thayná NunesThe present work has as Objective: To analyze whether the child who suffered from emotional or material abandonment by the parents may be released from the obligation to care for and support them in old age. Method: As for the level of depth, this is exploratory research, with a qualitative approach, carried out through bibliographic and documentary research. Results: Through research carried out, it was possible to verify that the Court of Justice of São Paulo decided that the daughter who suffered emotional abandonment by the parent, had the right to refuse to take care of it, even the Court of Justice of Ceará, Distrito Federal and Rio Grande do Sul, dismissed the parents' request for alimony about the children due to emotional abandonment. Conclusion: It is concluded that, if the parent does not comply with their constitutional rights, disrespecting the principles of family law, such as that of affection and solidarity, it is possible that the judges dismiss the request for care, protection when necessary by him in old age.
